On March 24, 2023, New York State’s Governor Hochul signed bill S01322, amending Laws S. 6291-A and A. 7063-A to prohibit the intentional use of Per- and poly-fluoroalkyl substances (PFAS) in apparel.
What are Perfluorinated Compounds and Perfluorinated Chemicals?
PFAS, also known as perfluorinated compounds (PFCs) and perfluorinated chemicals (PFCs), are classified as persistent chemicals. These chemicals are widely used in industrial and consumer products due to their exceptional durability and water resistance.
They are regularly used in products such as non-stick cookware, electronic products – as well as textile and apparel. However, previous studies have indicated that the chemicals remain persistent in the environment and can potentially cause adverse health effects.
Effective Dates and Revised Requirements for New York’s PFAS Amendment
The amendment to New York’s law prohibiting PFAS in apparel and outdoor apparel for severe wet conditions will take effect on different dates: January 1, 2025, for apparel and outdoor apparel and January 1, 2028, for outdoor apparel for severe wet conditions.
The sale of apparel products containing PFAS at or above the level set by the Department of the Environmental Conservation (DEC) in regulation will be prohibited in New York State one year after the enactment of the regulation, but no later than January 1, 2027.
Certificate of Compliance for PFAS
A Certificate of Compliance authorized by the manufacturer stating that apparel and/or outdoor apparel for severe wet conditions meet the requirements can be produced to demonstrate compliance.
