Health Canada has rolled out a new regulation for carriages and strollers under the Canada Consumer Product Safety Act (CCPSA), named SOR/2023-101. The latest regulation is set to supersede the existing ones, taking a stride towards aligning the Canadian regulatory landscape with international standards.
Main Regulatory Updates to Carriages and Strollers in Canada
- Mechanical Standards – The inclusion of mechanical requirements from ASTM F833 or ISO 31110. Businesses dealing with carriages and strollers are now mandated to comply with either of these standards.
- Coating Material Requirements – Synchronize the applied coating materials requirements with the Toys Regulation (SOR/2011-17).
- Toxicological Requirements – The new regulation incorporates toxicological requirements from the Canadian Toys Regulations (SOR/2011-17).
- Phthalate Limits – Adoption of limits on the presence of phthalates. The rules in this respect align with the requirements laid out in the Canadian Phthalates Regulations (SOR/2016-188).
- Bilingual Warning Labels – Updated requirement for mandated warning labels and product information, including bilingual mandate requiring all official information and warnings to be written in both English and French.
Transitional Period and Compliance for SOR/2023-101
A transitional provision is also a part of the new regulation. This will provide businesses a grace period of 365 days from the date of publication of SOR/2023-101 to comply with the new regulations. This means all carriages and strollers manufactured, imported, advertised, or sold in Canada should adhere to the new regulations by latest December 4, 2023.
