What Is the Role of Petroleum Authority of Uganda (PAU)?

The Petroleum Authority of Uganda (PAU) serves as the regulatory body for the nation’s oil and gas sector. Established in 2013 under the Petroleum (Exploration, Development, and Production) Act, PAU achieved full operational status in 2016. It plays a crucial role in regulating and overseeing activities related to oil and gas exploration, development, and production.

What Is the Uganda PAU National Database?

The PAU has established the National Supplier Database (NSD) for companies seeking to provide goods, services, and works to Uganda’s oil and gas sector. This is a central database of individuals and entities involved in petroleum activities in Uganda. Note that all entities must be registered on this database to provide goods, services, or works for oil and gas activities.

The registration process is free of charge and requires document submission. All applicants undergo verification within two months. Upon successful submission and review, businesses are listed in the NSD for three years from the qualification date. To stay on the register, they must reapply thereafter.

As of December 26, 2023, the key requirements, outlined by the PAU, include:

  1. Proof of legal status and name: Submission of an authentic and valid Certificate of Incorporation and/or registration.
  2. Submission of authentic, valid, and up-to-date information on shareholding and management.
  3. Good market conduct, ensuring no reported cases of blacklisting for the company, entity, or individual seeking registration.
  4. Good liquidity status.
  5. Proof of compliance with tax and social security requirements.
  6. Valid banker’s reference letter.
  7. Proof of nationality, tax registration, expertise, and a report of good conduct by the Police for natural persons.
  8. All submitted documents should be in English or translated into English where necessary.

AQM BD was appointed by the Uganda National Bureau of Standards (UNBS) to provide Uganda Pre-Export Verification of Conformity (PVoC) services for exports of regulated products to Uganda.

Over six months have passed since the UNBS appointed AQM BD as a service agent for Uganda PVoC certification. AQM BD spoke with its client, Elchemy, a leading new age chemical distribution company. 1. Did your company encounter any obstacles while exporting goods to Uganda prior to seeking a PVoC service?

Yes we encountered some difficulties while exporting to Uganda with other inspection agencies. Such as lack of coordination and not having clarity about exact requirement, which consumes more time for order processing and that’s the reason we started having business with AQM BD.

1.Quantity Check

The inspector will ensure that the number of products is precisely the same as the order in terms of sizes, colors, types, number of boxes in a cargo, etc.

2. Workmanship Assessment

At this step, the inspector will check the following points:

Missing glue: Glue is vitally important to ensure the products are long-lasting. The inspector will check the glue is enough to make the shoes firm and strong, not too much to impact the aesthetic value of the products.

In 2019, the EU imported furniture worth 20.62 billion euros from countries outside the European Union. What is the EUTR Regulation?

The European Union Timber Regulation (EUTR) is aimed at combatting illegal timber trade and promoting sustainable sourcing practices within the furniture industry. Introduced in 2010, the EUTR came into effect on March 3, 2013, with the primary goal of ensuring that timber and timber products entering the EU market are derived from legal and responsibly managed sources.

In early 2020, the European Commission conducted a “fitness check” on the FLEGT Action Plan and EUTR to assess their effectiveness. Issues identified include inconsistent implementation and enforcement across member states, the need for better cooperation, clear definitions of key concepts, and improved transparency in reporting. Additionally, the EU is working on a regulation for deforestation-free products, which may integrate the EUTR in addressing broader deforestation concerns.

Products Covered by the EUTR

The EUTR covers a wide range of products, identified based on the Combined Nomenclature (CN) used by customs to classify goods when entering the EU market. Examples of regulated products include:

The EUTR provides a list of products that are subject to its supervision and regulation. Due to the sheer number of regulated products, the EUTR does not list the individual kind of products. Instead, the covered products are identified based on the Combined Nomenclature (CN) – which is used by the customs to classify goods and products when entering the EU market.

Below are some examples of products of different categories for which EUTR applies. They cover wooden furniture, construction materials, decors, packaging materials, pulp, and buildings:

  • CN code 9403 30 – Wooden furniture of a kind used in offices
  • CN code 9403 40 – Wooden furniture of a kind used in the kitchen
  • CN code 9403 50 00 – Wooden furniture of a kind used in the bedroom
  • CN code 9403 60 – Other wooden furniture
  • CN code 9406 00 20 – Prefabricated buildings
  • CN code 4410 – Particle board, oriented strand board
  • CN code 4411 – Fibreboard
  • CN code 4412 – Plywood, veneered panels, and similar laminated wood
  • CN code 4414 00 – Wooden frames for paintings, photographs, mirrors, or similar objects
  • CN code 4415 – Packing cases, boxes, and similar products

 

EUTR Requirements

The EUTR mandates specific documentation for timber and timber products entering the EU market, this includes:

  • Wood Species Description: Listed in the Annex to Council Regulation (EEC) No 2658/87
  • Certificate: It is the responsibility of operators to guarantee that the timbers or timber products they deal with are sourced from legal and compliant origins, adhering to the chain of custody at every stage. As part of this process, a crucial requirement is obtaining a certificate from a trusted third-party authority like CITES, FLEGT, or FSC. This certificate serves as a tangible proof of the product’s legality and compliance with the essential regulations, adding credibility to the supply chain and ensuring the sustainable and responsible sourcing of timber and timber products.
  • Other documents: Supporting documentation that can help to mantain traceability and compliance such as audit reports, import/export licenses, enviromental assesment and certificates and more.

 

What is the UKTR Regulation?

The UK Timber Regulation (UKTR) is a regulatory framework based on the EUTR, specifically introduced after the UK’s departure from the European Union. he UKTR became applicable on January 1, 2021, following the end of the Brexit transition period.

What are the differences between the EUTR and the UKTR?

As we explained before the UKTR is based on the EUTR and the policy owner of UKTR, DEFRA, currently has no plans to make any changes. The differences are minimal, being the biggest difference the definitions of operators and traders. We need to remark that changes in the EUTR will not lead to changes in the UKTR automatically, thus we can expect these both regulations to be more and more different in the future.

What Is the Uganda CoC (PVoC)?

The Uganda PVoC is a certification that attests the products exported to Uganda conform with the applicable Uganda standards. This certificate is an integral component of Uganda’s PVoC programme, operated by the Uganda National Bureau of Standards (UNBS). The UNBS has designated PVoC Service providers to issue certifications upon successful compliance.

Why Is the Uganda PVoC Important for Exporters?

What Are the Penalties for Non-Compliance?

It’s important to note that all goods covered by the Uganda Standards under the Schedule of Compulsory Uganda Standards must hold an Uganda PVoC. Shipping non-compliant products will result in a non-conformity report (NCR), and these products will not be allowed to enter Uganda.

What Products Are Exempt From the Uganda PVoC?

There are certain products thare are exempt from PVoC certification, but instead subject to inspection at the destination. These products include:

  • Consignments with an FOB value under USD 2,000 (excluding motor vehicles).
  • Goods profiled by Uganda as low risk.
  • Specific government project commodities.
  • Diplomatic cargo.
  • Personal belongings of returning residents and expatriates.
  • Religious literatures.
  • Industrial machinery, farm equipment, and mining apparatus intended for manufacturing and not resale.

How to Get Uganda CoC?

1. Preparation

Familiarise yourself with the standards, quality, and labelling requirements relevant to your product. Below is a list of products that require Uganda PVoC certification.

2. Contact an Approved Uganda PVoC Provider

Contact an authorised Uganda CoC provider, such as AQM BD, to receive a comprehensive overview of the steps relevant to your product and company. There are four primary routes to consider, depending on whether you’re an occasional exporter, frequent exporter, high-volume frequent exporter, or a UNBS-registered consolidator as seen below.

3. Testing in Laboratory

Ensure products undergo testing in an ISO 17025 accredited laboratory and obtain a test report. Make sure that you have an invoice for the consignment.

4. Inspection and Techincal Review

The Uganda PVoC agency will arrange a physical inspection of your goods. The inspector will gather documentation, adhere to a sampling plan, execute inspection procedures, take photographs, create an inspection report, and seal the container upon completion of the inspection.

Concurrently, the Uganda PVoC provider will review the technical files, inspection report, test reports, and other documentation related to your application.

Upon satisfactory results and full compliance with Ugandan Standards, the Uganda PVoC service provider grants the Certificate of Conformity.
